1. Acceptance of Terms

By accessing or using the website, services, facilities, and/or membership programs of FITNESS EXEMPLIFIED WELLNESS PRIVATE LIMITED MANIKONDA, operating under the brand name FITX1 Fitness & Wellness ("FITX1," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("T&C"). If you do not agree to these T&C, you must not use our services or facilities.

2. Membership and Access

2.1. Eligibility: Membership is available to individuals who are 18 years of age or older. Minors (under 18) may be eligible for membership with the express written consent and signature of a parent or legal guardian, who must agree to be bound by these T&C. 2.2. Membership Dues and Fees: All members must pay membership dues and other applicable fees as specified in their individual Membership Agreement. The Company reserves the right to adjust fees with at least thirty (30) days prior written notice to members. 2.3. Termination by Company: We reserve the right to suspend or terminate a membership for any reason, including but not limited to: (a) failure to pay membership fees; (b) breach of these T&C or gym rules; (c) conduct we deem detrimental to the use and enjoyment of the facility by other members or staff.

3. Use of Facilities and Services

3.1. Assumption of Risk: You acknowledge that physical activity and the use of gym equipment involve inherent risks of injury, illness, or death. You voluntarily assume all risks associated with the use of our facilities and services. 3.2. Health and Safety: You represent that you are in good physical condition and have no medical condition that would prevent you from using the gym facilities or participating in fitness programs. You agree to stop immediately and seek medical attention if you experience pain, dizziness, or unusual discomfort. 3.3. Personal Training: Personal training services must be booked and paid for through FITX1. Unauthorized outside personal training is strictly prohibited. 3.4. Rules and Regulations: Members must adhere to all gym rules and regulations posted at the facility, including dress code, equipment usage, and facility cleanliness.

4. Website and Intellectual Property

4.1. Website Use: You agree to use the website only for lawful purposes. You shall not post or transmit any material that is unlawful, harmful, defamatory, or violates the rights of others. 4.2. Intellectual Property: All content on the https://fitx1gyms.in/ website, including text, graphics, logos, images, and software, is the property of FITNESS EXEMPLIFIED WELLNESS PRIVATE LIMITED MANIKONDA and is protected by Indian and international copyright and trademark laws.

5. Limitation of Liability and Indemnification

To the extent permitted by law, FITNESS EXEMPLIFIED WELLNESS PRIVATE LIMITED MANIKONDA, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from (a) the use or inability to use the facilities or services; (b) unauthorized access to or alteration of your data; (c) any injury or damage to person or property arising out of the use of the facilities.

You agree to indemnify, defend, and hold harmless FITNESS EXEMPLIFIED WELLNESS PRIVATE LIMITED MANIKONDA from any claims, damages, liabilities, and expenses arising out of your breach of these T&C or your use of the facilities.

6. Governing Law and Jurisdiction

These T&C shall be governed by and construed in accordance with the laws of India. Any disputes arising under these T&C shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, or Hyderabad, Telangana, where the relevant membership was initiated.

No Refund Policy

This Policy governs the cancellation of memberships and services, and the financial terms regarding refunds at FITNESS EXEMPLIFIED WELLNESS PRIVATE LIMITED MANIKONDA, operating as FITX1 Fitness & Wellness.

1. No Refund Policy

1.1. Finality of Payments: All sales of memberships, personal training packages, class fees, registration fees, and other services purchased from FITX1 are final and strictly non-refundable. 1.2. Non-Transferable: Membership packages, sessions, and payments are non-transferable to another person or location, and cannot be exchanged for cash or credit, regardless of usage. 1.3. Service Usage: The Company shall not issue refunds, credits, or extensions for any unused portion of a membership, unused personal training sessions, or missed classes due to non-attendance, illness, or change of personal circumstances.
